INSPECTION OF WORK

 Decisions of the Architectural Committee and the reasons therefore shall be transmitted by the Architectural Committee to the applicant at the address set forth in the application for approval, within thirty (30) days after receipt by the Architectural Committee of all materials required by the Architectural Committee.  Any application submitted pursuant to this Section 2 shall be deemed approved, unless written disapproval or a request for additional information or materials by the Architectural Committee of such application or additional information.

 

Inspection of work and correction of defects therein shall proceed as follows:

1)      Upon the completion of any work for which approved plans are required under this Article X Section 6, the Owner shall give written notice of completion to the Architectural Committee.

2)      Within sixty (60) days thereafter, the Architectural Committee or its duly authorized representative may inspect such Improvement.  If the Architectural finds that such work was not done in substantial compliance with the approved plans it shall notify the Owner in writing of such noncompliance within such sixty (60) day period, specifying the particulars of noncompliance, and shall require the Owner to remedy the same.

3)      If upon the expiration of thirty (30) days from the date of such notification the Owner shall have failed to remedy such noncompliance, the Architectural Committee shall notify the Board in writing of such failure.  After affording such Owner notice and hearing, the Board shall determine whether there is a noncompliance and, if so, the nature thereof and the estimated cost of correcting or removing the same.  If a noncompliance exists, the Owner shall remedy or remove the same within a period of not more than forty-five (45) days from the date of announcement of the Board ruling.  If the Owner does not comply with the Board ruling within such period, the Board, at its option, may record a notice of noncompliance in the Office of the Kern County Recorders and may peacefully remove the noncom plying Improvement or otherwise peacefully remedy the noncompliance, and the Owner shall reimburse the Master Association, upon demand, for all expenses incurred in connection therewith.  If such expenses are not promptly repaid by the Owner to the Master Association, the Board shall levy a special Reimbursement Assessment against such Owner for reimbursement.

4)      If for any reason the Architectural Committee fails to notify the Owner of any noncompliance within sixty (60) days after receipt of said written notice of completion from the Owner, the Improvement shall be deemed to be in accordance with said approved plans.
